Agreement to Terms

By accessing or using the Port City Holsters LLC website and purchasing our products, you agree to be bound by the Terms of Service.  If you do not agree to these terms, please do not use our website or purchase our products.

Company Information

Port City Holsters LLC is a limited liability company operating in Wilmington, North Carolina, specializing in custom Kydex holsters and tactical gear. 

Product Description and Custom Orders

Standard Products

We manufacture high-quality holsters and tactical equipment.  Product descriptions, images, and specifications on our website are provided for informational purposes and represent our best efforts to accurately describe our products.

Custom Orders

Many of our products are custom manufactured to order based on specific firearm models and customer preferences.  Custom orders are non-refundable except as specified in our Lifetime Guarantee and Return Policy.  By placing a custom order, you acknowledge that:

  • Production time varies based on current order volume.
  • Custom specifications will be manufactured as requested.
  • Changes to custom orders may not be possible once production begins. 

Pricing and payment

All prices are listed in U.S. Dollars and are subject to change without notice.  We reserve the right to modify pricing at any time, though orders already placed will honor the price at the time of purchase.

Payment is due at the time of order placement.  We accept major credit cards, debit cards and other payment methods as displayed during checkout. 

Order Acceptance and Cancellation

We reserve the right to refuse or cancel any order for any reason, including by not limited to:

  • Product availability
  • Errors in pricing or product information
  • Suspected fraudulent or unauthorized transactions
  • Compliance with applicable laws and regulations

If your order is cancelled after payment, we will issue a full refund to your original payment method.

Shipping and Delivery

Shipping Terms

We ship to addresses within the United States.  Shipping times are estimates and not guaranteed.  Port City Holsters LLC is not responsible for delays caused by shipping carriers, weather, or other circumstances beyond our control. 

Risk of Loss

Risk of loss and title for products purchased from Port City Holsters LLC pass to you upon delivery to the shipping carrier.

Damaged Shipments

If your product arrives damaged, please contact us within 7n days of delivery with photographic evidence.  We will arrange for a replacement or refund as outlined in our return policy.

Lifetime Guarantee and Returns

Port City Holsters LLC offers a Lifetime Guarantee on all products manufactured by us.  Please refer to our separate Return Policy for complete details regarding:

  • Lifetime warranty coverage
  • Damaged or defective items on arrival
  • Return procedures and timeframes
  • Refund and replacement options

Product Use and Safety

Proper Use

Our holsters and tactical gear are designed for specific firearms and use cases.  It is your responsibility to:

  • Ensure proper fit for your specific firearm model
  • Follow all firearm safety rules and regulations
  • Use products only as intended
  • Maintain products according to provided instructions
  • Regularly inspect products for wear or damage

 Assumption of Risk

Firearms are inherently dangerous.  By purchasing and using our products, you acknowledge and assume all risks associated with firearm ownership, handling, and use.  You agree to use our products safely and in compliance with all applicable federal, state and local laws. 

No Liability for Misuse

Port City Holsters LLC is not liable for injury, death, or property damage resulting from:

  • Improper use of our products
  • Failure to follow safety procedure
  • Negligent handling of firearms
  • Use of damaged or modified products
  • Failure to regularly inspect products

Legal Compliance

Firearms Regulations

You represent and warrant that:

  • You are legally permitted to own and possess firearms in your jurisdiction
  • Your purchase and use of our products complies with all applicable federal, state, and local laws.
  • You will not use our products for any unlawful purposes

Our products are subject to U.S. export control laws.  You agree not to export or re-export our products without appropriate licenses or authorization.

Intellectual Property

All content on this website, including text, images, designs, and logos (collectively, 'Content') is owned by Port City Holsters LLC or its licensors and is protected by applicable intellectual property laws.  You may not copy, reproduce, modify, distribute, or create derivative works from the Content without our prior written consent.  Any names, logos, or trade dress used on the site that identify our products or services may constitute unregistered (common law) trademarks of Port City Holsters LLC.   

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORT CITY HOLSTERS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECAIL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Use or inability to use our products. 
  • Unauthorized access to or alteration of your transmissions or data
  • Any conduct or content of any third party
  • Any injury, death, or property damage related to firearm use.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. 

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. 

Indemnification

You agree to indemnify, defend, and hold harmless Port City Holsters LLC< its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of our products
  • Your violation of these Terms of Service
  • Your violation of any rights of another party
  • Your violations of any applicable laws or regulations

Dispute Resolution

Governing Law

The Terms of Service shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

Arbitration

Any dispute arising out of or relating to the Terms of Service or our products shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.  The arbitration shall take place in Wilmington, North Carolina. 

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Exceptions

Either part may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights or confidential information. 

Modification to Terms

Port City Holsters LLC reserves the right to modify these Terms of Service at any time.  Changes will be effective immediately upon posting to our website.  Your continued use of our website or products after changes are posted constitutes acceptance of the modified terms. 

We encourage you to review these Terms of Service periodically for any updates. 

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. 

Entire Agreement

These Terms of Service, along with our Privacy Policy and Return Policy, constitute the entire agreement between you and Port City Holsters LLC regarding your use of our website and purchase of our products.
